This comes weeks after Josh hit back at Christina in a divorce filing after she put their Tennessee home on the market.
In court documents obtained by DailyMail.com, Josh filed a temporary emergency order to stop the sale of their Franklin, TN home (also known as Parker Branch). He offered Christina a global settlement offer but then she proceeded to list it.
He also said that she allowed him to live in the home when it was unoccupied, which he did for 12 days in September, but now he has relocated somewhere else in Tennessee and claims he’s ‘suffering prejudice’ because his living expenses will increase.
In the documents, Josh claims the home was listed by Christina without his consent and without a court order.
The home was purchased by Christina in February 2021, prior to their wedding, however Josh insists ‘the community maintains an appreciation interest due to the paydown of the mortgage during marriage.
‘A premature sale may result in prejudice to me as property values continue to rise in Tennessee, which continues to grow in population.’
Josh alleges Christina asked for his ‘written agreement’ to sell the home on September 23, however he did not agree.

The former couple filed for divorce after over two years of marriage
He also claims Christina presented him with a proposed Stipulation and Order in connection with the home on September 24, an agreement he claims she ‘unilaterally prepared.’ He did not sign that document.
Josh alleges he then presented Christina with a global settlement offer on September 25.
The settlement contained terms related to the home, but Christina rejected the proposal on September 30th.
Josh alleges Christina went ahead with the ‘unliteral listing’ of the home without his consent. The home was listed for $4.5 million.
He claims he learned about the listing on social media and through his counsel, informed Christina that they did not have a settlement and he did not agree to the sale of Parker Branch.
Josh claims Christina told him his objection was ‘ineffective’ and she allegedly has refused to take down the listing.
He also alleged that he and Christina were able to come to an agreement about using their Newport Beach and Parker Branch homes during their separation.
The former couple agreed that Christina would enjoy ‘exclusive use and possession’ of their home in Newport Beach while Josh would be able to reside in Parker Branch, which also serves a short-term rental part-time, when it was not in use.
Josh relocated to Tennessee due to the agreement they made and lived in Parker Branch for 12 days during the month of September. But when the home was being used by short-term tenants, he stayed with family.
‘My relocation to Tennessee was significantly influenced by our aforementioned Stipulation allowing me to enjoy this property throughout our separation. I will now suffer prejudice because my living expenses will undoubtedly increase,’ he claimed.
Josh insisted there would be ‘no prejudice’ to Christina if his request is granted by the court.
‘She is enjoying our community residence,’ he added. ‘She is in control of our entire marital estate. She has cut me out of our businesses post-separation, impacting my earnings.
‘Christina has continued to maintain the marital status quo while I have endured significant changes, to my detriment.’

‘I anticipate that Christina will claim that this sale is in the “usual course of business.” Any such argument is a farce. Parker Branch was purchased for us to enjoy as a family. It was not a business investment,’ he added.
Josh alleged that Christina intends to sell the home in order to follow her dreams of owning a vineyard in Napa.
‘Christina has claimed that she wishes to sell Parker Branch so that she can pursue her new dream of owning a vineyard in Napa Valley. This is an entirely new and impulsive venture for her, unrelated to any “usual” business that she has engaged in,’ he wrote.
‘In summation, there exists no compelling basis to sell the Parker Branch property during the pendency of this action,’ he concluded. ‘I am requesting that the Court grant immediate orders to prevent the immediate loss of the Parker Branch residence.’
In the event his immediate request to stop the sale goes unfulfilled, Josh and his lawyers are seeking to swiftly schedule a date in court where they will ask a judge to prevent the sale of the home.

Hall took a dig at Josh in her post.
She noted that he can no longer live there and made him out to be a freeloader who has wanted her money.
‘I guess Leiper’s Fork is gonna have to come off the bio soon,’ she began the Instagram Story. He had Leiper’s Fork in his Instagram bio. ‘Time to go back to reality soon… ‘
She then turned the knife to go deeper.
‘Remember when you said you would never steal from me or my kids and you would just be happy in a van with your dog?’ she asked.
‘I guess plans changed. All about trying to take everything you can… With your mind on my money and my money on your mind…. Byeeee.’
When they split, Josh moved out of their $12M Newport Beach, California mansion and into the Tennessee home.
Their split has been very contentious and public with Christina often calling him out on social media.
